THE EXPERIENCE WORKSHOP
RACE + RELIGIOUS - FEB. 18+19, 2025
Effective Date: March 4th, 2024
Please read the Terms of Use for THE EXPERIENCE WORKSHOP (NOLA) carefully and in their entirety before purchasing and using THE EXPERIENCE WORKSHOP (NOLA) (hereinafter referred to as the “Workshop”). The Workshop and its content are owned by Skye Edmonds and Work of Heart Photo.
Definitions:
“Company”, “We”, “I”, “Our”, or “Us” means Skye Edmonds and Work of Heart Photography
"Participation”, “Participating”, “Using”, or “Use” means reading, implementing, trying, or otherwise engaging in the Workshop.
“You” or “Your” means the purchaser and person using the Workshop.
Consent:
By purchasing and/or participating in the Workshop, you implicitly and voluntarily agree to act in accordance with, agree to, and abide by, these Terms of Use.
You have read, understood and agree to the following:
Refunds: Attendee understands that the Workshop fee is non-refundable, no exceptions.
Attendee Transfer: Attendee understands you may sell your Workshop spot and you are responsible for doing so. Work of Heart Photography maintains the right to approve the proposed attendee transfer.
Switching Workshops: Attendee understands there is a $200 fee to switch to another active Workshop; only with Skye’s approval.
Payment + Purchase Terms
If you choose the installment payment plan for the Workshop, you hearby agree to the following payment schedule (NO LONGER AVAILABLE).
Initial payment of $500 to book spot.
Second payment of $500 on or by July 1st, 2024
Third and final payment of $500 on or by November 1st, 2024
In the event that payment is not successfully made by the due date, you have a three (3) day grace period to make your payment of the Workshop. If such payment is not received, your access to and participation in the Workshop will not continue. If you fail to make payment within the grace period or at any other time, you are still responsible for all payments for the full cost of the Workshop.
Weather: Attendee understands this Workshop will carry on rain or shine.
Acts of God, Terrorism or Civil Unrest:
Attendee understands that Work of Heart Photography is not responsible for Acts of God, Terrorism or Civil Unrest. Such events can ruin Workshops and are out of our control. Work of Heart Photography will do its best to conceive of potential remedies (such as rescheduling a Workshop) but is not responsible for any loss, damage, injury, incurred by the attendee.
Neither party shall be liable for any costs or damages due to delay or nonperformance under this Agreement arising out of any cause or event beyond such Party’s control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, epidemic, pandemic, accident, work stoppage, chemical spill, power or other mechanical failure, governmental action, or communication disruption. A Party claiming the benefit of this provision shall, as soon as reasonably practicable after or during the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance under this Agreement, as applicable, as soon as reasonably practicable.
Industry Specific Knowledge: Attendee understands that your expected to have a working knowledge of your camera and understands the basics of photography (exposure, lighting, etc.) – although you don’t have to have a business to go to the Workshop, attendee knows Work Of Heart Photography will offer no teaching or guidance at this event.
Workshop Venue: Attendee understands that it’s a priority for Work Of Heart Photography to maintain a good working relationship with the owner of the property; therefore, attendee agrees to leave each shooting location as they found it and if possible better (picking up your trash, not posing kids in potentially dangerous situations, etc.). Attendees caught willfully damaging venue property will result in the removal from the Workshop without refund. Any damage fees levied against Work of Heart will be charged to the responsible party.
Model Compensation: Attendee understands that the models have given their time to model at the Workshop. Many traveling from other states and miss school. Models will be compensated in the form of photos taken by all attendees. To "thank them" for their time, attendee will give them 4-5 of your favorite images of each model you shoot within three weeks of the completion of the Workshop. Attendees are under no obligation to photograph all or even most models. In exchange, attendee will be given a legal model release, so that they may legally use their images on my business website, marketing materials, etc.
Credits: Attendee understands to give credit where credit is due. Attendees will be shooting various sets styled and setup by Work Of Heart Photography (Skye Hardwick Edmonds) Attendee will give her credit for their efforts by giving mention on Attendee’s facebook page and/or blog. Attendees do not need to do this on their website or marketing materials.
Workshop Conduct: Attendee understands that Work of Heart photography has established a workflow for our Workshop event to create the best environment for photo-shoots and will respect the guidelines put in place (shooting in an assigned small group, not switching sets until time, not straying from set with a minor child, etc.) when it's time to end the shoot time, you will respect that and wrap up.
Attendee understands Skye Hardwick Edmonds and Workshop Assistants will be shooting along with attendees during the various shoots.
Attendee understands shooting at a Workshop is like “controlled chaos” and that Skye Hardwick Edmonds and her team will work hard to make it the best shooting experience as possible (read: breaking into smaller groups, organization).
Attendee understands you need to be a respectful of other attendees during the Workshop shoot times and take turns with other photographers. If another photographer is working with a child to connect with them for a shot, you will give them space and room to work. Attendee understands others may want to work with a particular model, so you will get your shots and move on.
Attendee understands the need to be respectful of my iPhone picture taking (Facebook, Instagram & etc.) and not to take pictures or video during teaching times. Also, keeping in mind other attendees may not want to be included (ask first) and that attendee should not take social media pics of the child models.
Wardrobe, Set and Props Treatment: Attendee understands you are “protect and preserve” Work Of Heart Photography’s Workshop clothing, sets and props. Any damages created due to your actions and/or instructions contrary to the understanding to “protect and preserve” the attendee understands will be expected to fully reimburse Work Of Heart Photography for cost of the item(s). Attendee understands your not to have any models sit or lay down on the ground without explicit permission from Skye Hardwick Edmonds herself. Nor will you ask the models to play “rough games” such as ring-around-the-rosey or “red rover”.
Attendee understands you may not submit the images taken at Work Of Heart Photography Workshop to magazines (online or print), contests in any form (Shoot & Share Contest), or inspiration blogs or any commercial promotion without written permission from Work Of Heart Photography.
Attendee understands you will not solicit business from the models parents or exchange contact information.
Workshop Culture: Attendee understands they need to come with a great attitude, willing heart and ready to have fun.
This Agreement contains the entire agreement between the parties on its subject matter and supersedes any prior understanding or representation of any kind preceding the date of this Agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement.
Limitation of Liability:
Skye Edmonds is not responsible or liable in any way for any and all damages you receive directly or indirectly from your participation in the Workshop. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) the Workshop or its content, due to any act, or failure to act, by you. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.
Severability
The provisions of these Terms of Use shall be deemed severable, and the invalidity or un-enforceability of any provision shall not affect the validity and enforceability of any other provision hereof. If any Section, subsection, sentence, or clause of these Terms of Use shall be adjudged illegal, invalid, or unenforceable, such illegality, invalidity, or un-enforceability shall have no effect on the Terms of Use as a whole or on any Section, subsection, sentence, or clause hereof not expressly so adjudged.
By purchasing and/or participating in the Workshop you implicitly signify your agreement to all of the terms in these Terms of Use.
